Prayer in this writ petition is for issuance of direction to the respondents to release all retiral benefits stated to be due to the petitioner, including that of gratuity, leave encashment, P.F., etc. Learned counsel for the petitioner submits that he has instructions to the effect that all benefits except LTC and interest on delayed payment have since been released to the petitioner. Therefore, at this stage, a limited prayer is addressed that legal notice dated 07.06.2022 (Annexure P-6), submitted by the petitioner in respect to release of LTC and interest on delayed payment be directed to be decided by the respondents in a time bound manner.
Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to consider and decide petitioner's legal notice dated 07.06.2022 (Annexure P-6) to the SUNIL 2022.08.10 10:45 I attest to the accuracy and integrity of this document
CWP-17388-2022 -2extent as above, by passing a speaking order, in accordance with law, within a period of three months from receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within the next two months thereafter.
