**** KIRTI SINGH, J. (Oral) This petition under Section 439 Cr.P.C. has been filed for grant of interim bail to the petitioner for three weeks for the treatment of wife in case bearing FIR No.38 dated 08.02.2024 under Sections 15/25 of the NDPS Act, 1985 registered at Police Station City Barnala, District Barnala, Punjab. 2.

Learned counsel for the petitioner submits wife of the petitioner is suffering from cholelithiasis with chronic cholecystitis and she needs to be operated and there is nobody to attend his wife and he is only male member in the family and there are four minor children. 3.

In compliance to order dated 10.07.2024, status report dated 15.07.2024, by way of affidavit of Satvir Singh, PPS, Deputy Superintendent of Police, Sub Division Barnala, District Barnala, on behalf of the respondent-State, has been filed by learned State counsel, in Court today, which is taken on record.

That the present petition has been filed by the petitioner for the grant of interim bail of 03 weeks for the treatment of his wife. In his regard, it is submitted that as per the report of doctor, "As per USG report she was suffering from Cholelithiasis,(Gallsbladder). Surgery is the treatment for that symptomatic treatment can be done C medicine. It is not urgency as per reports. As per basis report all are normal. So no immediate surgery needed." It is further submitted that as per statement of Daljit Kaur wife of petitioner and joint statement of respectable person of locality, in the family of petitioner, Daljit Kaur (wife of petitioner) along with her 4 children is alone in her house."

In view of the contentions made by learned counsel for the petitioner and status report submitted by learned State counsel and considering the fact that the wife is along with children, this Court is of the view that the petitioner is entitled to concession of interim bail at this stage. Accordingly, petition stands allowed and petitioner is granted interim bail for a period of 02 weeks from the date of his actual release, on his furnishing bail bonds/surety bonds to the satisfaction of the learned Trial Court/Duty Magistrate concerned, on usual terms and conditions.
