Dated Police Station Sections 13.07.2020 City Barnala, District Barnala 22 of NDPS Act (25, 29 of NDPS Act, 1985 and 7, 13 of Prevention of Corruption Act, 1988 and 465, 467, 468, 471, 120-B IPC, 1860 added later on) The petitioner incarcerated for more than 04 years in the FIR captioned above had come up before this Court under Section 439 CrPC, 1973, seeking regular bail. 2.

State counsel submits that all prosecution witnesses have been examined, statements under section 313 Cr.P.C. have also been recorded and now the trial is at defence stage and thus, the ball is not in the court of the State. 4.

However, counsel for the petitioner submits that the accused who are on bail are delaying the trial by way of seeking adjournments time and again. 5.

Given above, the present petition is disposed of with direction to the trial Court that in case any adjournment is sought by the accused who are on bail in that case trial Court is requested to cancel their bail in accordance with law and shall avoid unnecessary adjournment. The State is also directed not to seek any unnecessary adjournment(s). Pending applications, if any, also stand disposed of.
