M.M.S. BEDI, J. (ORAL) Petitioner who claims himself to be a labour contractor has sought a direction to the respondents to release the payment of Rs.19,25,000/- along with interest for the labour and cartage work performed by him for PUNSUP agency by unloading bags of foodgrains to M/s Pal Agro and M/s J.K.Agro, Sarabha Mandi, District Ludhiana on the directions of PUNSUP agency.

The petition involves a number of questions of facts. It will not be appropriate for this Court to enter into the controversy. However, it will be expedient, in the interest of justice, in case a direction is issued to the Managing Director PUNSUP-respondent no.3, to ensure that the legal notice dated 22.12.2016, Annexure P18, is considered within a Raj Kumar Arora 2017.02.08 14:47 I attest to the accuracy and integrity of this document

This petition is disposed of with a direction to the Managing Director, PUNSUP, respondent No.3, to consider the claim of the petitioner as raised vide notice dated 22.12.2016, Annexure P18, within a period of two months after the receipt of a certified copy of this order by passing a speaking order. In case notice dated 22.12.2016, Annexure P18, has not been received by the said authority, it will be the duty of the petitioner to communicate the direction passed by this Court along with a copy of the petition to the Managing Director, PUNSUP, respondent no.3. In case the petitioner is found entitled to the amount claimed or lessor or more amount than the amount claimed, the same may be released to the him.
