The present writ petition has been filed seeking appointment as Male Constable (General Duty), pursuant to having participated in Advt. No.8/2015 in Category No.1.

Learned counsel appearing on behalf of the petitioner herein would contend that the petitioner had answered correctly 61 questions as per the answer key and 19 questions were wrong, in total 80 questions were attempted. It is submitted that in case OMR sheet of the petitioner is produced, it would reflect that he had secured sufficient marks to have been called for interview and subsequently, appointed on the said post. Pursuant to the notice of motion having been issued, reply has been filed and coloured photostat copy of OMR sheet of the petitioner has been produced in Court in a sealed cover, which stands opened. CWP No.17285 of 2020 (O&M) -2reply, it is submitted that the petitioner had obtained 54.75 marks whereas the last selected candidate had obtained 54.95 marks and therefore, not having adequate merit, petitioner was not offered appointment. Counsel for the petitioner has been given an opportunity to recalculate the marks after having a look at the OMR sheet pertaining to the petitioner as well as the revised answer key supplied to him in Court itself. After going through the same and recalculating the marks, counsel for the petitioner on being satisfied that the petitioner does not fall within the zone of consideration, does not press the instant petition. Consequently, the instant petition stands disposed of, as the petitioner does not have requisite marks for being selected on the post of Male Constable (GD) in Category No.1.
