During the course of pendency of this petition under Section 439 Cr.P.C., the petitioner had been ordered to be released on interim bail vide order dated 24.7.2019 as report of FSL was still awaited. However, subsequently on 23.10.2019 the said interim order was withdrawn. The order dated 23.10.2019 reads as follows:
"Learned State counsel submits that as per report of FSL, narcotics recovered from the petitioner was 'Buprenorphine'. Petitioners were allowed interim bail due to non-receipt of report of FSL. As the FSL report has been received, orders allowing interim bail to petitioners are withdrawn and they are directed to surrender before the trial Court within ten days." Learned State counsel has submitted that despite the petitioner having been directed to surrender before the Trial Court within 10 days, vide order dated 23.10.2019, he has not surrendered so far.
