The present writ petition has been filed under Articles 226/227 of the Constitution of India, praying for issuance of an appropriate writ in the nature of mandamus directing respondent No.3 not to relieve the petitioner from the Mill's service on 30.06.2026 upon attaining the age of 58 years, as the petitioner is covered under the Sugar Wage Board, wherein the age of retirement is 60 years. A further prayer has been made to do away with the discrimination caused to the petitioner by the respondents, which is violative of Articles 14, 16 and 21 of the Constitution of India, as all ClassIII employees are retiring at the age of 60 years. been made to stay the retirement of the petitioner from the Mill's service on 30.06.2026 during the pendency of the present writ petition. 2.

At this stage, learned counsel for the petitioner wishes to withdraw the present writ petition with liberty to avail the alternative remedy available to him in accordance with law. 3.

In view of the above, the present petition is dismissed as withdrawn with liberty aforesaid.
