(ORAL) On 9th of September, 2022 following order was passed :- "Learned counsel for the petitioner herein would contend that even though the petitioner has been denied one mark on account of over-writing, which deduction he disputes considering the fact that this issue had not been raised at any relevant time, he would still be entitled to additional marks on account of his Class-1 Commendation Certificate, annexed with the writ petition as Annexure P-4 and in case, the said marks are added, he would have equivalent marks to that of the last person in the waiting list.
Let the record of the petitioner be re-looked at and in case, it is found that the petitioner herein is entitled to that additional marks for his certificate Annexure P-4, the same be accorded to him, otherwise, let an affidavit be filed showing his ineligibility for the said marks.
Adjourned to 11.11.2022."
Today, learned State Counsel submits that even if the petitioner is awarded 1/2 mark for the commendation certificate he would still be at DEEPAK KUMAR 2023.04.25 09:08 I attest to the accuracy and integrity of this document
CWP-21350-2014 (O&M) -22023:PHHC:056378 Sr. No.30/A in the waiting list which has 31 persons and none of the persons on the waiting list could make it to the Lower School Course for that year (2013) and thus the present writ petition is merely at the most an academic exercise as the same would not bear any relief to the petitioner. Counsel for the petitioner does not dispute the aforesaid fact. Resultantly, the present writ petition is dismissed as having been rendered infructuous.
