CORAM:

Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. Swapan Shorey, Advocate, for the petitioner.

**** Rakesh Kumar Jain, J. (Oral) This petition is filed for seeking a writ in the nature of certiorari for quashing the letter dated 01.04.2016 (Annexure P-9). In short, the petitioner is a resident of Italy holding Indian passport No.F4947859. The said passport had expired on 02.07.2016. However, before its expiry, the petitioner applied for renewal of the passport on 31.12.2015 vide application No.CH2079500248415. The passport authority sent a notice dated 01.04.2016 to the petitioner seeking clarification as it was found that one Vishal Mahajan, (Saddhu) of the petitioner, lodged an FIR No.57 dated 16.04.2013, under Sections 451, 147, 149, 342, 506, 323 IPC at Police Station Baddi against the petitioner and his in laws. The petitioner filed reply dated 05.05.2016 to the said notice, as demanded by the passport authority but, thereafter, nothing has been done

Vinod Kumar 2016.09.27 12:08 I attest to the accuracy and authenticity of this document Chandigarh CWP No.19696 of 2016 [ 2 ] ***** by the passport authority either to accept the application of the petitioner or to reject the same.

The petitioner has wrongly framed the prayer as the only relief which can be granted to the petitioner at this moment is to issue a direction to the passport authority (respondent No.2) to pass orders on the application of the petitioner, which has been made by him for renewal of his passport, one way or the other.

Thus, the present writ petition is hereby disposed of with a direction to respondent No.2 to decide the application of the petitioner by which he has prayed for renewal of his passport, one way or the other, within a period of 15 days from the date of receipt of certified copy of this order.
