Present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case bearing FIR No.37 dated 26.02.2023, registered for the offences punishable under Sections 465, 467, 471, 120-B of IPC (Section 420 and 468 of IPC added later on) at Police Station City Jalalabad, District Fazilka.

On 10.04.2024, while noticing the following submissions made by the learned counsel for the petitioner, a Coordinate Bench of this Court had asked the petitioner to join investigation:- "In compliance of the order dated 06.10.2023, Harjit Singh, the husband of the complainant who is allegedly in a relationship with the petitioner has filed an application for cancellation of transfer deed in favour of the petitioner before the Court of SDM, Jalalabad.

Xxxx xxxx xxxx In the meantime, the petitioner is directed to join investigation once again.

Interim order to continue."

Learned counsel for the petitioner submits that in compliance of order dated 10.04.2024, the petitioner has joined investigation and cooperated with the investigating agency.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 10.04.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
