3. Whether the judgment should be reported in the Digest? --- Surya Kant, J. (Oral) The petitioners are residents of village ChandSamad, Tehsil Indri, District Karnal. They allege that the Gram Panchayat is hell-bent to dispossess them from the subject site where old residential houses are in existence. Heard learned counsel for the petitioners.

It appears from the photographs on record that some of the houses are old but a fresh construction was also raised but it has been demolished. It further appears that there was an unsuccessful attempt to encroach upon the Gram Panchayat land.

In these circumstances when it is difficult to ascertain whether there exists old houses as shown in the photographs, we dispose of this writ petition with a direction to the B.D.P.O., Indri to visit the site and if it is found that the houses are quite old, in that event, the Gram Panchayat may be advised to initiate eviction proceedings in accordance with MOHINDER KUMAR 2015.09.30 16:30 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.20679 of 2015 [2] law. However, if any attempt is being made to forcibly occupy the Gram Panchayat land, the authorities shall be well within their right to prevent such attempt.
