The petitioner-Gram Panchayat has approached the Deputy Commissioner-cum-Collector, Yamuna Nagar through BDPO, Bilaspur, to grant permission for leasing out the land measuring 421K-07M, which is otherwise reserved for common purpose, i.e. Gau Charand. The Director Development and Panchayat Department, Haryana, has also vide Memo dated 31.05.2017 asked the Deputy Commissioner to take a decision within ten days. It appears that the authorities are sitting tight over the matter as they are unable to decide whether Gau Charand land can be leased out for agricultural purpose. We are of the view that such a decision has to be taken by the Deputy Commissioner-cum-Collector strictly in accordance with the Rules and the utilisation plan, if any, approved for the Gram Panchayat. Let an appropriate decision be taken within two weeks from the date of receipt of a certified copy of this order. Disposed of.
