Gurvinder Singh Gill, J (Oral) The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR 63 dated 04.04.2019 registered at Police Station, Division - B, Amritsar, District Amritsar under Sections 307, 427, 148 and 149 IPC and under Sections 25 and 27 of Arms Act, 1959.
The FIR was lodged at the instance of Robin Rai, wherein it has been alleged that on the day of occurrence, co-accused Ankur Kahlon @ Anterpreet Singh fired a shot from his pistol hitting Rajat Kumar in his abdomen, Tejpreet Singh (petitioner) is alleged to have fired from his pistol hitting the complainant on his left wrist.

CRM-M-30024-2019 (O & M) [2] The learned counsel for the petitioner has submitted that infact the FIR came to be lodged under some mistaken belief and that the misunderstandings have now been resolved and the parties have effected a compromise. The learned counsel, in this context, has referred to an affidavit (Annexure P-1) furnished by the injured Rajat Kumar, wherein he has categorically deposed therein that none of the accused was seen on the day of occurrence at the spot and that none of the accused had fired any shot at him.
Although, learned State counsel has shown ignorance about the compromise, learned counsel for the petitioner has shown a photocopy of order dated 11.07.2019 passed in CRM-M-28139 of 2019 i.e. bail petition filed on behalf of co-accused Ankur Kahlon @ Anterpreet Singh, a perusal of which shows that complainant Rajat Kumar had appeared in person before this Court and had admitted the factum of compromise and consequently, this Court had granted bail to co-accused Ankur Kahlon @ Anterpreet Singh.
In view of the aforestated position and without commenting anything on the merits of the case, the petition is accepted and petitioner Tejpreet Singh is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of Trial Court/ Chief Judicial Magistrate/ Duty Magistrate concerned.
The petition stands accepted accordingly.
