CRM-M-33513-2023 Present petition has been filed under Section 482 Cr.P.C. inter alia seeking issuance of direction to official respondent Nos. 2 to 4 to submit the police inquiry report with regard to representation dated 31.05.2023 (Annexure P-2), submitted by petitioner to respondent Nos. 3 and 4 and, thereafter,the same be marked to respondent No.2. Further direction to official respondent Nos. 2 to 4 to decide his representation dated 31.05.2023, in the interest of justice. Further, prayer has been made by petitioner to immediately provide interim protection of at least two security guards to him and his family members keeping in view the threat perception.

Succinct facts first, as pleaded in the petition. 2.1.

Petitioner is stated to be a practicing Advocate in Ludhiana and is also a public activist taking necessary steps to bring to the knowledge of 

competent authorities to take action against the erring citizens, who are engaged in encroaching public land, including the case in hand. 2.2.

Respondent No.5-Inderjeet Singh Pamma had encroached upon public land meant for parking of vehicles at Chaura Bazar, Ludhiana. A case titled 'Gurinder Singh Sood V. Inderjit Singh Pamma and others under Section 133 Cr.P.C. was also pending adjudication before learned Sub. Divisional Magistrate, Ludhiana East, District Ludhiana.

On 30.05.2023 at about 4:30 p.m., respondent No.5 Inderjeet Singh Pamma sent some unknown persons including women at the office premises of petitioner situated at Chaura Bazar, Ludhiana, who openly threatened to harm the petitioner and his family members, if he does not immediately withdraw all the pending cases against respondent No.5.

Petitioner moved complaint/representation dated 30.05.2023 (Annexure P-2) against respondent No.5 for threatening petitioner through his accomplices and further to withdraw all court cases against respondent No.5, but in vain. Hence the instant petition.

Per contra, learned State counsel submits that petitioner is not entitled to any relief from this Court.

Petition is disposed of with a direction to Commissioner of Police, Ludhiana to look into the entire matter afresh and depute a police official not below the rank of Inspector who shall submit an action taken report before the Illaqa Magistrate.

Needless to say that if any action is warranted, further steps be taken in accordance with law.

In case petitioner is aggrieved against the action taken report to be filed before the Illaqa Magistrate, he shall be at liberty to take judicial recourse in accordance with law including taking steps under Section 156 (3) Cr.P.C. 8.
