-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in case FIR No.202 dated 16.12.2020 registered under Section 364 IPC (Sections 364-A, 120-B, 201, 328 IPC added later on) at Police Station, Sector 65, Gurugram.
In brief, the facts are that the aforesaid FIR was registered by the complainant-Balraj contending that his minor son was missing and that he had received a telephonic call demanding a ransom for his release. Learned counsel appearing on behalf of the petitioner would contend that two co-accused have already been released on regular bail and therefore, he seeks parity with them.
Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner by contending that the victim has identified the petitioner-Mohit @ Bhola and his uncle Jagdish, owner of the auto rickshaw in which he was kidnapped. It is submitted that the coaccused Vishnu and Dharambir, who had been released on regular bail, were PANKAJ KUMAR 2022.02.09 16:14 I attest to the accuracy and authenticity of this document
CRM-M No.38504 of 2021 (O&M) -2instrumental only in purchasing a sim card from which phone call was made for demanding ransom and therefore, their roles cannot be equated. I have heard learned counsel for the parties and find no ground for grant of regular bail to the petitioner herein, considering the fact that statement of victim is yet to be recorded and he has already identified the petitioner herein as one of the persons, who had kidnapped him. However, as the petitioner is in custody since 26.12.2020, the trial court is directed to make an endeavour to conclude the trial expeditiously. With the aforesaid observation, the instant petition stands dismissed.
