(ORAL) Feeling aggrieved against the order dated 8.9.2016 (Annexure P-15) passed by Assistant Collector, Ist Grade, Hisar, petitioners have approached this court by way of present writ petition, under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Certiorari for quashing the impugned order.

Having heard learned counsel for the petitioner at some length and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present writ petition is disposed of, with liberty to the petitioners to file their appeal against the impugned order before the District Collector. However, it is directed that the appeal of the petitioners alongwith stay application shall be entertained by the District Collector, Hisar. He shall decide the appeal or atleast the stay matter at an early date, by passing an appropriate order thereon, strictly in accordance with law, but in any case within a period of three weeks from the date of Greesh Sahni 2016.09.23 16:24 I attest to the accuracy and integrity of this document Chandigarh

Thereafter, he shall also ensure early decision of their appeal, by passing an appropriate order thereon, strictly in accordance with law. The petitioners shall be at liberty to raise all possible pleas available to them and such pleas raised on behalf of the petitioners, shall be considered and decided by the District Collector, while deciding their appeal.

With the above said observations made and directions issued, present writ petition stands disposed of.
