Seeking initiation of criminal proceedings under Section 191/193/199/200/420/467/468/120-B IPC for giving false evidence in the form of written statement before this Court in CWP No.1679 of 2020, the petitioner has come up before this Court under Section 340 CrPC.

Counsel for the petitioner submits that a matter with similar prayer is pending before the Civil Court and he be permitted to withdraw the present petition with liberty to file fresh petition after decision of said civil suit. 3.

Counsel for respondents No.1 and 2 has no objection to the prayer of counsel for the petitioner.

Given above, the present petition is disposed of as withdrawn. In case, petitioner files fresh petition under Section 340 CrPC/379 BNS, the Registry shall not raise any objection, provided the same is filed within 100 days of the date of decision of civil suit which is pending before Civil Court as per petitioner. All pending applications, if any, stand disposed of.
