Petitioner has impugned order, Annexure P-1 passed by Presiding Officer, Labour court, Ambala whereby Managing Director of Haryana Distillery Ltd. has been summoned to appear in person. It is urged before the court that Distillery is being represented by a counsel and a whole time Director is already appearing before the Labour court. As reference is still pending adjudication, personal appearance of the Managing Director would not serve any purpose as petitioner would be bound by the award ultimately passed. This court finds substance in this plea. Under the circumstances, petition is disposed of with the observation that Presiding Officer, Labour court may not insist of presence of Managing Director of Haryana Distillery Ltd unless it is absolutely necessary.
