Gurnam Sing H v. State Of Punjab & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 20825 of 2015 Date of decision: 30.09.2015 Gurnam Singh ....Petitioner(s)
Versus
State of Punjab and others
...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. Surinder Garg, Advocate, for the petitioner.
G.S.SANDHAWALIA, J. (Oral) The claim in the present writ petition is for releasing the balance of the retiral dues of the petitioner, who is alleged to have retired on 29.02.2012 as Accounts Clerk from the office of respondent no. 5. Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the legal notice dated 06.07.2015 (Annexure P-3) within a time bound frame since details have been mentioned in the said legal notice. In view of the limited relief sought, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 06.07.2015 (Annexure P-3) and decide the same within a period of 2 months from the date of receipt of certified copy of the order. In case the amounts are due, the said amounts be released to the petitioner within a period of one month thereafter. Needless to say that in case the relief is to be denied, the order should contain reasons.
