Dated Police StaƟon SecƟons 10.04.2021 Patran, District PaƟala 15 of NDPS Act (29 NDPS Act added later on) The peƟƟoner incarcerated in the FIR capƟoned above, has come up before this Court under SecƟon 439 CrPC seeking bail. 2.

Counsel for the peƟƟoner seeks bail on the grounds of long pre-trial incarceraƟon.

Custody cerƟficate dated 11.08.2023 filed by State counsel today in the Court is taken on record. State counsel submits that the peƟƟoner is not enƟtled to bail as per the judgment of Hon'ble Supreme Court in the case of Dheeraj Kumar Shukla v. The State of UƩar Pradesh [SLP (Crl) 6690-2022], decided on 25 Jan 2023 because as per custody cerƟficate, his custody is 02 years and 04 months and not 02 years and 06 months. 4.

At this stage, counsel for the peƟƟoner wants to withdraw the present peƟƟon with liberty to file fresh peƟƟon with same power of aƩorney aŌer compleƟng 02 years and 06 months of custody.

Given above, the present peƟƟon stands disposed of having been withdrawn. Since peƟƟoner-Satnam Singh @ Sonu has already given power of aƩorney to JYOTI 2023.08.11 15:44 I attest to the accuracy and integrity of this order/judgment.
