The present petition has been filed under Section 482 of Cr.P.C. seeking quashing of order dated 02.12.2022 (Annexure P-4) passed by learned Sub Divisional Judicial Magistrate, Nangal arising out of FIR No.204 dated 17.09.2020 under Sections 307 IPC, 1860 and Sections 27, 54, 59 of Arms Act registered at Police Station Nangal, whereby the petitioner has been declared as a proclaimed person.

Learned counsel for the petitioner contends that the procedure before declaring the petitioner a proclaimed person, has not been adhered to, as per law. Learned counsel for the petitioner, on instructions further submits that the petitioner undertakes to appear before the trial Court concerned on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before the trial Court. Hence, in the aforementioned facts and circumstances, the petitioner prays that directions be issued to the Trial Court concerned that his bail application, which he would be filing on his surrender, be decided. 3.

I have heard learned counsel for the petitioner and perused the material placed on record.

No legitimate ground to interfere in the impugned order dated 02.12.2022 is made out and the present petition is hereby, dismissed. 7.

However, in case the petitioner surrenders before the trial Court within 07 days from today and moves an application for grant of regular bail, on his doing so, the trial Court shall consider and decide the same within a period of 03 days thereafter.
