Petitioner possessing qualification of B.Ed., applied for the post of Teacher pursuant to advertisement published in July 2007 (Annexure P-1). As per advertisement first preference was to be given to 10+2 and ETT candidates and in case of non-availability of such candidates candidature of persons having higher qualification i.e. B.A./B.Ed., was to be considered. In the said selection process, petitioner was kept in waiting list.

Grievance of the petitioner is that she has not been appointed despite posts lying vacant due to non-availability of 10+2 and ETT candidates/ termination of services of selected candidates having fake/bogus degrees.

Prayer is for directing the respondents to consider and appoint the petitioner against the post of ETT teachers, so advertised in the year 2007.

After hearing the learned counsel for the petitioner and perusing the averments made in the petition, in my opinion, no interference is warranted under Article 226 of the Constitution, as stale Rajinder Parshad Joshi 2017.02.21 18:10 I attest to the accuracy and integrity of this document

CWP 19872/2016 claim of the petitioner is hit by delay and laches. She had applied in the year 2007. Even if posts are still lying vacant, still no directions can be issued to respondents to consider the claim of the petitioner after delay of more than 9 years.
