Prayer in this petition filed under Section 482 of Cr.P.C., is for issuance of direction to learned trial Court in FIR No.45 dated 11.07.2015 registered under Section 365 IPC at Police Station Gardhiwala, District Hoshiarpur (Annexure P-4) to decide the matter within a period of four months in view of Article 21 of the Constitution of India.

Learned State counsel submits that after a thorough investigation, a cancellation report was prepared and submitted before the jurisdictional Court. The complainant/petitioner has already filed a protest petition and the same is pending consideration before the jurisdictional Court.

Without commenting further on the merits of the case and in view of the peculiar facts and circumstances of the case and also in view of the fact that the jurisdictional Court is seized of the matter, the present petition is disposed of.

The learned jurisdictional Court is directed to consider the cancellation report as well as the protest petition filed by the petitioner and pass appropriate order strictly in terms of the judgment rendered by this Court in Pawan Kharbanda vs State of Punjab and another, passed in CRM-M No.3193 of 2025, decided on 29.01.2025, after affording adequate opportunity to the petitioner to file his written objections if any, with regard to any shortcomings and bias in the investigation carried out by the investigating agency.
