Prayer made in the present petition for directing the respondents to promote the petitioner as Senior Assistant w.e.f. October 1999 and subsequently other higher posts, might not, due to efflux of time, even be surviving.

In para 2 of the reply on merits filed by the Registrar, Punjab Agricultural University dated 30.08.2011, it has been stated that the petitioner was called in October 1999 to consider his case to the next higher post of Senior Assistant. However, the Board of the respondent-University, in its meeting held on 31.01.2000, had decided that the post of Senior Assistants and Senior Assistants (A/Cs) be merged with immediate effect and the posts of Senior Assistants (A/Cs) placed at the tail of Senior Assistants seniority list. Resultantly, the seniority of the incumbents was redetermined. No Senior Assistant (A/Cs) was promoted to the post of Senior Assistant between the period 01.10.1999 to 17.02.2000 before the merger of two cadres and thus the petitioner was not entitled for promotion or other benefit. He was, though, granted one advance increment vide order dated 09.04.1985 in lieu of his passing the Lower Standard Departmental Examination.
