The grievance of the petitioner is that against order dated 27.2.2013 (Annexure P2), he preferred an appeal, which is pending adjudication. He also moved an application for staying the operation of order, which is also pending consideration for 27.9.2016. It is the contention of learned counsel for the petitioner that if order dated 27.2.2013 is given effect to, it will defeat his right in appeal as well, thereby foreclosing his option in the event of his dispossession. After hearing learned counsel for the petitioner, we deem it appropriate to dispose of the instant petition without issuing notice of motion to the other side but with a clear direction to the Collector, Kaithal before whom appeal is pending, to decide the matter regarding stay on 27.9.2016, the date fixed before him.
