Gurminder Singh v. State Of Punjab And ORS
CWP 1462/2018
IN THE HIGH COURT OF PUNJAB & HARYANA
AT CHANDIGARH CWP 1462/2018 Date of decision:10.08.2018 Gurminder Singh ..............Petitioner v.
The State of Punjab and others ..............Respondents Coram:
Hon'ble Mr.Justice Jaswant Singh Present:- Mr.Rajbir Singh,Advocate for the petitioner Mrs.Anu Chatrath Kapur,Addl.AG Punjab Jaswant Singh,J,(Oral).
The petitioner was an aspirant for enlistment as a Constable against 3% seats reserved for sportsmen pursuant to the advertisement dated 23.11.2016. Twenty vacancies of Male constables were earmarked under the said category. The selection process consisted of marks of sports trial and marks for sports achievement. The maximum marks were 50 with 25 marks each assigned to the aforesaid two tests. A candidate was required to obtain a minimum of 12.5 marks in the sports trial of concerned sports. The petitioner cleared the sports trial. However, it is claimed that marks for some of the achievements were not assigned on the ground that the originals were not produced at the time of scrutiny of the documents since the originals were in the custody of an office where the election records were placed, therefore those could not be released and produced by the petitioner at the time of scrutiny. The same were, however, subsequently produced. During the course of previous hearing, respondents were RAJINDER PARSHAD JOSHI 2018.08.10 17:47 I attest to the accuracy and integrity of this document
CWP 1462/2018 directed to reconsider the allotment of marks to the petitioner on the basis of originals which could not be produced earlier for no fault of the petitioner. Upon reconsideration and in compliance of the previous directions especially the order dated 17.7.2018, fresh appointment letter has been issued to the petitioner subject to the terms and conditions which he has accepted. Affidavit dated 10.8.2018 alongwith Annexure R-1 has been placed on record.
Counsel for the petitioner states that since his client has joined duties pursuant to the appointment letter, hence nothing more survives for adjudication in this petition.
Disposed of accordingly.
