Today, at the very outset, learned counsel representing the petitioners submits that he may be permitted to withdraw the present petition. He has, however, submitted that since petitioners No.1 to 4 are aged persons their presence may be exempted before the Trial Court. 2.

In view of the aforesaid submission, the present petition is dismissed as withdrawn with liberty to the petitioners to raise all the pleas as have been raised hereby before the Trial Court at appropriate stage. 3.

The petitioners would be at liberty to move an appropriate application before the Trial Court seeking their exemption from personal appearance. 4.

CRM-M-34783-2024 (O&M) ( 2 ) Court choses to grant exemption, it shall be open to the Trial Court to impose any condition as may be deemed appropriate.

Needless to mention, the Trial Court would be at liberty to record evidence in the absence of the accused after taking due undertaking from accused, whose exemption is granted.
