G.S.SANDHAWALIA, J. (Oral) Prayer made in the present writ petition is for stepping up of the pay of the petitioners who are senior general category employees at par with their junior Sh. Parveen Kumar (Junior Scheduled Caste Reserved Category employee) having seniority number 748.

The petitioners allege that they are serving with Water Supply and Sanitation Department and are entitled for the stepping up of the pay in accordance with the judgments of this Court in CWP No. 5956 of 2008, Charan Dass vs. State of Haryana decided on 18.11.2008; CWP No. 17280 of 2011, Prem Kumar Verma and others vs. State of Haryana decided on 07.08.2012 and CWP No. 18307 of 2011, Gurmeet Singh and another vs. Punjab School Education Board and others decided on 06.12.2012.

Counsel for the petitioners submits that a legal notice dated 07.07.2015 (Annexure P-6) has already been served upon respondent no. 1 for the necessary relief but no action has been taken. Counsel submits that he would be satisfied if a direction is issued to the respondents to take a decision on the said legal notice within a time bound frame.

Accordingly, without commenting on the merits of the case and in view of the fact that the legal notice is still pending consideration, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 1 to take into consideration the legal notice dated 07.07.2015 SHIVANI GUPTA 2015.10.01 16:57 I attest to the accuracy and integrity of this document Chandigarh

-2- (Annexure P-6) and decide the same within a period of 4 months from the date of receipt of certified copy of the order. In case the representation is decided in favour of the petitioners, the amounts due be paid within a period of 2 months thereafter. Needless to say that in case the relief is to be denied, the order should contain reasons.
