Mr. D.S. Patwalia, Sr. Advocate with Mr. APS Sandhu, Advocate for respondent Nos.1 & 2. Mr. Amrit Paul, Advocate for respondent No.3. JASWANT SINGH, J (ORAL) The four petitioners, who were appointed as Lecturers in different streams in the year 2007 with the privately managed Aided College, namely, Khalsa College affiliated to Guru Nanak Dev University, Amritsar, have challenged order dated 27.8.2015 (P.7) whereby the respondent-College has imposed the condition of obtaining/passing Ph.D degree within the prescribed period, failing which, the monetary benefits are/were withdrawn, and which were to culminate into termination of their services as well. Upon notice, separate replies on behalf of the College and University have been filed.

At the time of hearing today, learned counsel for the respondents-College submits that the Management of the College

CWP No.20888 of 2015 #2# has since reconsidered the matter and vide resolution dated 23.1.2016 withdrawn the impugned orders. Letter dated 10.3.2016 issued by Honorary Secretary of Khalsa College Charitable Society, Amritsar, in this respect, along with copy of resolution dated 23.1.2016 is taken on record as Mark A. From the reading of this document Mark-A, it is evident that not only the monetary benefits would flow retrospectively and recoveries stopped, even the recoveries already effected, would be liable to be refunded.

Faced with aforesaid facts, learned counsel for the petitioners is agreed that no further adjudication is required. In view the above, present petition is dismissed as having become infructuous. Respondents shall be bound by their aforesaid stand in Mark A.
