(ORAL) Instant writ petition under Articles 226/227 of the Constitution of India has been filed for quashing the new policy dated 30.01.2015 (Annexure P-4) issued by respondent No.5 - Director General (Land Work Estate)/Policy (Quarter) and the orders issued by Station Commander, Station Hqrs, Chandimandir/Chandigarh - respondent No.4 in pursuance thereof contained in communications dated 12.08.2015 (Annexure P-5), dated 27.08.2015 (Annexure P-6), dated 05.09.2015 (Annexure P-7) and dated 25.09.2015 (Annexure P-8), whereby directions have been given to vacate the premises in question by 04.10.2015 In pursuance of notice of motion, respondents have appeared. Heard.
Period to vacate the premises is going to expire on 04.10.2015. Learned counsel for the respondents, after seeking instructions from RAVINDER SINGH 2015.10.05 16:45 I attest to the accuracy and authenticity of this document
-2CWP No.20891 of 2015 Major Rahul Soni, OIC Legal, Western Command, submits that they have no objection if the petitioner is allowed to remain in accommodation for one month.
In view of above, petitioner is allowed to remain in the premises in question upto 05.11.2015 on payment of rent as per policy/rule in this regard. In the meantime, petitioner will make arrangement for alternative accommodation. Petitioner is directed to file an undertaking within a week before the Station Commander, Station Headquarter, Chandimandir Cantt. that he will vacate the premises on or before 05.11.2015 failing which writ petition shall be deemed to be dismissed.
Disposed of.
