The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of order dated 04.05.2026 (Annexure P-47) whereby respondent has decided its representations dated 26.11.2025 and 13.01.2026.

This is second round of litigation. The petitioner on an earlier occasion approached this Court by way of CWP No.2285 of 2026 which was disposed of vide order dated 25.03.2026 with a direction to respondents to decide petitioner's representations. The respondent by way of order dated 04.05.2026 has held that the petitioner being the contractor is responsible for the quality of material supplied by the manufacturer. It cannot shift its responsibility onto the manufacturer. As per the agreement, the contractor bears overall responsibility of procurement, installation and rectification of defects. There exists no privity of contract between GMADA and OEM. The petitioner submits that the respondent has addressed its representation in a vague manner and in contravention to the undertaking before this Court. Learned counsel for the petitioner submits that petition may be disposed of with liberty to avail alternative remedy as per contract read with policy (Annexure P-44) framed by the State Government. 4.
