(ORAL ) The present petition has been filed under Section 438 of the Code of Criminal Procedure (for short 'the Cr.P.C.)' praying for grant of anticipatory bail in FIR No.64 dated 13.06.2019, under Sections 420, 406 and 120-B IPC, registered at Police Station City Jalalabad, District Fazilka. CRM-M-29933-2019 (O&M) It has been contended by the learned counsel for the petitioners that the petitioners have been wrongly involved in the present FIR and it is the outcome of a civil dispute between the parties pertaining to purchase of some paddy.
On 17.07.2019, this Court had issued notice of motion and arrest of the petitioners was stayed till the next date of hearing. On 26.08.2019, the petitioners were granted ad-interim bail subject to the satisfaction of Investigating/Arresting Officer and compliance of provisions of Section 438 (2) Cr.P.C. Today, on instructions from the police official assisting the learned State counsel, he states that the petitioners have already joined investigation and are no longer required for custodial interrogation. In view of above stand taken by the learned State counsel, the present petition is allowed. Interim order dated 26.08.2019, is hereby made absolute.
