The present petition has been filed invoking the jurisdiction of this Court by concealing the material facts and the truth and by misleading this Court by stating that the daughter of the petitioner was a minor 17 years old girl, who had been forcibly kidnapped by respondents No. 4 & 5. 2.

This Court taking the matter seriously entertained the same, however, on 13.07.2023, the counsel for the State submitted that the parties were called to the Women Police Station on 08.07.2023, where the petitioner as well as the alleged detenue voluntarily got their statements recorded that the daughter of the petitioner had married respondent No. 4 on her own will and more so, recorded in her own handwriting that she was 21 years old.

2023:PHHC:090963 CRWP-6748-2023 (O&M) her daughter and had wrongly or purposefully with a mala fide intention stated her daughter to be a minor. Learned counsel for the petitioner despite being given opportunity two times has not bothered to look into that aspect. 4.

Even today, the counsel for the petitioner is arguing against the statement suffered by the petitioner as well as the detenue for the reasons best known to her.

In light of the above, the present petition is an abuse of process of law and deserves to be dismissed with exemplary cost, however, since counsel for the petitioner has submitted that the petitioner is a house wife, the cost is not being imposed and a word of caution is issued that in case, the petitioner approaches the competent authority with any lie, appropriate action shall be taken against her in accordance with law. 6.

Accordingly, the present petition stands dismissed. 7.
