The petitioners through instant petition under Article 226 of the Constitution of India are seeking compensation at market rate on account of utilization of their land qua laying of 220 KV transmission line as per provisions of Electricity Act, 2003 read with Indian Telegraph Act, 1885 and guidelines dated 14.06.2024. They are further seeking direction to respondents to decide their representation dated 27.02.2026. 2.
The petitioners are builders who acquired land to develop a colony under the name 'Fortune County'. While the development process DEEPAK BISSYAN 2026.05.22 16:53 I attest to the accuracy and authenticity of this order/judgment
CWP-15918-2026 -2was underway, respondent No.2 started laying a 220 KV transmission line through the petitioner's licensed residential colony. Public notices and notification qua proposed transmission line were issued without granting effective opportunity to them. They became aware of respondent's project on 07.01.2019 when officials reached the project site for erection of transmission towers and laying foundation. The petitioners approached this Court by way of CWP-12249-2019 challenging the notification and erection of high-tension towers through their residential township which was disposed of vide order dated 22.12.2021 in terms of settlement dated 10.06.2021 arrived at between the parties.

Learned Senior Counsel for the respondent No.2 submits that competent authority would consider petitioners' claim and address their grievance within six weeks from today. They would be granted opportunity of hearing before passing order.

In the wake of statement of both sides, the petition stands disposed of. The petitioners at the first instance would appear before respondent No.2-Sr. Executive Engineer, TLSC Division, Mohali at 11:00 AM on 15.06.2026 and thereafter as directed by said authority. 5.
