(Oral) The petitioner has approached this Court seeking issuance of a direction to respondent No.3 i.e. Superintendent of Police, Jind to pass a fresh order on his representation dated 27.08.2021 (Annexure P-7), as the order dated 09.08.2021 (Annexure P-2) has not been passed in total compliance of order dated 08.07.2021 (Annexure P-1) passed by this Court in CRWP No.6217 of 2021, wherein a specific direction had been issued by this Court that the contents of the CD to be furnished by the petitioner would also be examined.

Mr. Rajiv Sidhu, learned Deputy Advocate General, Haryana appearing on behalf of the respondent-State accepts notice and has submitted that although there is no specific reference to the CD in question in the order dated 09.08.2021, but in fact the contents of the same were duly examined and it was pursuant thereto that the petitioner has been found to be innocent VANDANA YADAV 2021.09.24 17:03 I attest to the accuracy and integrity of this document

CRM-M-38658-2021 (O&M) in FIR No.233 dated 07.05.2021 registered at Police Station Kaithal City, Kaithal, wherein challan has already been presented. It has further been submitted that it was in connection with the said FIR No.233 dated 07.02.2021 that the police has visited the residence of the petitioner on 27.06.2021 in respect of which DDR No.50 dated 27.06.2021, Police Station Bhawnpur, has also been recorded.

I have considered the respective submissions addressed before this Court.

Having regard to the fact that there is no specific reference to the CD in the order dated 09.08.2021, the instant petition is disposed of with a direction to respondent No.3 - Superintendent of Police, Jind, to pass a fresh order on the representation dated 27.08.2021, while taking into account the contents of the CD in question within a period of 15 days from today.
