Petitioner was serving as Junior Engineer with PSPCL when his services were terminated vide order dated 26.8.2014 (P-2) in view of the conviction and sentence of the petitioner vide judgment dated 25.4.2014 (P1) passed in criminal trial inter alia for the offences under the Prevention of Corruption Act.

Present petition was filed seeking re-instatement in view of his acquittal on merits by the Appellate Court vide judgment dated 19.12.2017 (P-3).

Upon notice, an affidavit dated 11.9.2018 of Sh.Damanjit Singh Toor, Addl.SE, PSPCL has been filed alongwith an order dated 7.9.2018 (Annexure R-1) reinstating the petitioner.

In view of the same counsel for respondents states that the present petition has become infructuous.

In response,counsel for the petitioner submits that he be given RAJINDER PARSHAD JOSHI 2018.09.11 17:45 I attest to the accuracy and integrity of this document

CWP 14768/2018 liberty to pursue his right to the release of benefits for the intervening period whereas counsel for the respondents also seeks liberty for the employer to initiate fresh departmental proceedings, if warranted and advised.

In view of the aforesaid present writ petition is disposed of as infructuous.

Liberty is granted to both the parties to seek their remedy in accordance with law.
