Prayer in this writ petition filed by the petitioner under Article 226 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing respondents No.2 and 3 to release the arrears of higher pension payable to the petitioner under the Employees' Pension Scheme, 1995, along with interest @ 18% p.a. from the date the same became payable and due towards the present petitioner. 2.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding representation dated 23.02.2021 (Annexure P-3). He submits that at this stage, petitioner would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Hooda, Advocate, has accepted notice on behalf of respondents No.2 and 3 and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to decide representation dated 23.02.2021 (Annexure P-3), submitted by the petitioner expeditiously, by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.

Liberty is granted to the petitioner to supplement the representation dated 23.02.2021 (Annexure P-3) within a period of 02 weeks from today.
