The petitioner has approached this court invoking the writ jurisdiction under Article 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to dispense with the directions for depositing the licensed weapon of the petitioner, which has been issued to him for self defence. Claiming that oral direction of the respondents is contrary to the instructions issued by the Election Commission of India vide letter dated 1.9.2009.

Notice of motion to AG Punjab. At the asking of the court, notice has been accepted by Ms. Anu Pal, AAG, Punjab. Copy given. The petition is disposed of with a direction that before directing the petitioner to deposit his licensed weapon, his case will be considered as per the instruction of Election Commission of India No. 464/INST/2009/EPS dated 1.9.2009. Without considering the case of the petitioner, as per the above said instructions, no order requiring the petitioner to deposit his licensed weapon will be implemented in oral or in writing.

Disposed of with the above observations.
