ALKA SARIN, J.: (Oral) The present petition has been filed on the basis of a Special Power of Attorney executed and notarized in Canada. A perusal of the said Special Power of Attorney reveals that the same does not fulfil the requirements of Section 85 of the Evidence Act,1872 or the provisions of the Diplomatic and Consular Officers (Oaths and Fees) Act, 1948. Faced with the same, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh with a proper power of attorney.
