G.S.SANDHAWALIA, J. (Oral) The petitioner seeks regularization from the date the juniors have been regularized alongwith consequential benefits and arrears. It is the case of the petitioner that she was appointed on the post of Sweeper in Group-D on part time basis on 29.09.2000 and the appointment letter is appended as Annexure P-1. Several requests have been made for regularization of services and the grouse of the petitioner is that the juniors have been regularized. The details of the juniors have been given in para no. 8 and reference has been made to one Suraj Bhan, who was regularized on 27.07.2015 having been appointed after the petitioner on 09.10.2000. A perusal of the order of the said junior (Annexure P-5) would go on to show that regularization was done under the 2003 Departmental Policy on a Class-IV post.
Counsel submits that legal notice dated 27.04.2017 (Annexure P-6) has already been served upon the respondents regarding the said aspect but the same has not been decided. Counsel further submits that he would be satisfied if a direction is issued to the respondents to decide the said legal Shivani Gupta 2017.08.09 12:49 I attest to the accuracy and integrity of this document

Without commenting on the merits of the case or the entitlement of the petitioner for the abovesaid relief and keeping in view the fact that the matter is still pending consideration and it has been alleged that juniors have been regularized, the present writ petition is disposed of with direction to respondent no. 3 to take a decision on the said legal notice dated 27.04.2017 (Annexure P-6) within a period of 3 months from the date of receipt of certified copy of the order. Needless to say if the benefit is to be declined, a reasoned order be passed and the same be conveyed to the petitioner.
