IN THE HIGH COURT OF PUNJAB & HARYANA AT

CHANDIGARH Civil Writ Petition No.2016 of 2016 Date of decision: 1.2.2016 Harpal Singh ... Petitioner

Versus

PRTC ... Respondent

CORAM:

HON'BLE MR. JUSTICE RAJIV NARAIN RAINA

Present:

Mr.Vikas Chatrath, Advocate, for the petitioner.

***** 1.

To be referred to the Reporters or not?

2.

Whether the judgment should be reported in the Digest? RAJIV NARAIN RAINA, J. (Oral) The claim in this petition is for counting daily wage service rendered in 1978 for about six months with regular service for enhancing pension. The petitioner has served a legal notice dated 8.9.2015 [P-3] on the competent authority but lament that it has not been decided so far. The petitioner is a retired person. He is a senior citizen also. Instead of issuing notice of motion and protracting the proceedings in this Court, Mr.Vikas Chatrath states that his client would be satisfied if a direction is issued to the competent authority in the respondents to consider and decide the legal notice [P-3] in accordance with law and in a time bound period. The request is found genuine. PARITOSH KUMAR 2016.02.05 10:06 I attest to the accuracy and authenticity of this document

CWP No.2016 of 2016 : 2 :

Without making any comments on the merits of the case or on the law involved in the subject matter, a direction is issued to the respondents to consider and decide the legal notice within 6 weeks from the date of receipt of a certified copy of this order. Needless to say, that only in case an adverse order is to be passed or is contemplated, then the petitioner would be heard and a speaking order passed disclosing reasons for arriving at the conclusions. If the claim is found admissible, then benefit of the same is directed to percolate in the pockets of the petitioner within next 6 weeks. The petition stands disposed of as above.
