HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.444 dated 17.06.2019 under Sections 307,34 IPC and Section 25 of the Arms Act (Section 120-B IPC and Section 3 (2) (v)(a) of the Scheduled Castes and Scheduled Tribe (Prevention of Atrocities) Act, 1989 added later on), registered at P.S City Bhiwani, District Bhiwani. As per the allegations in the FIR, on 16.06.2019 at about 9.15 p.m, when the complainant was sitting in the street in front of house of Balwant Thekedar, then Vicky @ Vikram, Bintu and Chhotu @ Madda came there and after abusing the complainant, they went away. After some time, Bintu and Chhotu @ Mada stood near a shop and started doing recky of the complainant. Thereafter, Vicky @ Vikram and one more boy came there on a motorcycle and fired a shot upon the complainant with the intention to kill him. The bullet hit left elbow of the complainant. On hearing the noise, his brother Ajay and many other persons reached there and the assailants fled away from the spot.

CRM-M-33656 of 2020 #2# Learned counsel for the petitioner contends that the alleged injury inflicted on the complainant is on non-vital of the body i.e left elbow and that as per the contents of the FIR, no offence under the SC/ST is made out against the petitioner. The petitioner is in custody since 19.07.2019. Without commenting anything on the merits of the case and also bearing in mind the custody period besides the fact that the trial is unlikely to conclude in the near future more so in the wake of outbreak of pandemic Covid-19, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted.

The petitioner Vikram @ Vicky is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
