(ORAL) In the present writ petition, the grievance of the petitioner is that she has been granted the Special Pension to the tune of `13,500/- per month w.e.f. 18.10.2017, whereas the said pension was revised by the respondents w.e.f. 01.12.2011 and the similarly situated employees have already been granted the same from the said date i.e. 01.12.2011. Counsel for the petitioner relies upon order dated 14.09.1998 (Annexure P-1) where the recommendation has already been made to grant the special family pension @ `13,500/- per month w.e.f. 01.12.2011, but the said recommendation is still to be applied in this case and the case of the petitioner is pending consideration with the authorities and no final decision has been taken by the respondents so far. CWP-19418-2019 -2Counsel for the petitioner states that for the relief which has been sought in the present writ petition, the petitioner has served the respondents with a legal notice dated 28.06.2019 (Annexure P-7), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 28.06.2019 (Annexure P-7) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months.
Present writ petition stands disposed of.
