Coram:

Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. Gaurav Sharma, Advocate, for the petitioner.

***** Rakesh Kumar Jain, J.

This petition is filed for seeking a direction to decide the application dated 18.07.2017 (Annexure P-4) for setting aside the ex parte order and to entertain and decide the application for impleading the legal heirs of Dharam Pal.

Counsel for the petitioner has fairly conceded that the matter has already been argued and the judgment is reserved for pronouncement by the Competent Authority.

Dharam Pal, whose legal heirs are sought to be impleaded, died on 22.05.2015 but the application is stated to have been filed on 18.07.2017. It is nowhere mentioned in the petition as to on which date the judgment was reserved but it appears that the application, which is sought to be decided, was filed after the judgment was reserved in the main case. In view of the above, I do not find any merit in the present petition and hence, the same is hereby dismissed. July 31, 2017 (Rakesh Kumar Jain) vinod* Judge Whether speaking / reasoned:
