(Oral) The alleged civil suit filed by the petitioners challenging the competence of 'Power of Attorney' has already been dismissed and the appeal is pending adjudication. The present case is arising out of the mutation on the basis of the title.
It is settled law that mutation cannot be kept in abeyance in view of the judgment rendered by the Hon'ble Division Bench of this Court in Jagjit Singh vs. Divisional Commissioner, Patiala and others 2012(13) RCR (Civil) 96 as it is only for fiscal purposes. The petitioners are at liberty to take up all the pleas in grounds of appeal raised in the present writ petition. With the aforementioned liberty, the present writ petition stands disposed of.
