IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH

Date of Decision : 13.07.2015 Chand Singh ...... Petitioner versus The Haryana Power Generation Corporation Ltd. & anr. ...... Respondents CORAM : HON'BLE MR. JUSTICE AJAY TEWARI *** Present :

Mr. Satbir Singh Malik, Advocate for the petitioner.

Mr. P.S.Poonia, Advocate for respondents No.1 & 2.

***

1. Whether Reporters of local papers may be allowed to see the judgment?

2. To be referred to the Reporters or not?

3. Whether the judgment should be reported in the Digest? AJAY TEWARI, J. (ORAL) By this writ petition the petitioner has challenged the order whereby the deemed date of regularization earlier granted to him has been withdrawn.

Learned counsel for the petitioner has argued that the facts of the present case are covered by the decision of this Court in CWP No.11882 of 2013 decided on 19.02.2014 titled as "Maha Singh Vs. The Haryana Power Generation Corporation Limited and another". POOJA SHARMA 2015.07.16 10:59 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh

Learned counsel for the respondents has very fairly accepted that the case is covered by that decision but has stated that in that case originally the respondents had filed an LPA and on the dismissal thereof had filed SLP and that SLP was also dismissed. However liberty was granted to the respondents to again approach the High Court. When I put to him as to what has been the fate of the direction of the Supreme Court to approach this Court, he has stated that nothing has been moved till date and has prayed that this case be adjourned sine die to await the decision of that matter. In my opinion no ground is made out to await the outcome of the application which the respondents have even till date not filed. In the circumstances the petition is allowed in the terms of the above mentioned case. However, it is certified that this decision would be subject to any order which may be passed in the case relied upon. Learned counsel for the petitioner states that he is satisfied with this direction.

Since the main case has been decided, the Civil Misc. Application, if any, also stands disposed of. ( AJAY TEWARI ) 13.07.2015 JUDGE Pooja Sharma-I POOJA SHARMA 2015.07.16 10:59 I attest to the accuracy and integrity of this document Punjab and Haryana High Court, Chandigarh
