On our asking, Mr.Anil Mehta, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents.
Let five copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage.
The petitioner is aggrieved by non-inclusion of his own as well as the names of his family members in the voter list of village Utawat, Tehsil Hathin, District Palwal, which has been recently notified for the purpose of ensuing Gram Panchayat elections. CWP No.21210 of 2015 [2] family-members' names were duly mentioned in the aforementioned voter list in the year 2014. It is further alleged that their names are now completely missing and have not been included in any other electoral Rolls also. In the absence of any material on record to show that the petitioner is a bonafide resident of village Utawat, we do not express any opinion on merits but keeping in view the fact that the factual issue raised herein-above requires determination, we dispose of this writ petition with a direction to the Deputy Commissioner, Palwal, to ascertain the correct facts and take an appropriate decision as early as possible but before the Gram Panchayat elections.
