IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 21212 of 2015 Date of decision: 05.10.2015 Jaskirat Kaur ....Petitioner(s)

Versus

State of Punjab and another

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Bhupinder Ghai, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) Prayer in the present writ petition is for consideration of the case of the petitioner for appointment on compassionate basis on account of the death of her father.

Counsel for the petitioner submits that the petitioner's father had expired on 21.02.2006 while posted as a Patwari. The petitioner was minor at that point of time and also has two younger brothers. She had got married in 2012 and thereafter has filed a representation dated 26.11.2014 (Annexure P-3) to respondent no. 2 for the relief of compassionate appointment.

Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the said representation within a time bound frame.

Keeping in view the limited relief sought, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the representation dated 26.11.2014 (Annexure P-3) and decide the same within a period of 3 months from the date of receipt of certified copy of the order also keeping in mind the fact that there are two other legal heirs of the deceased-employee whose interest will have to be equally protected in case any relief is to be granted to the petitioners. Needless to say that in case the relief is to be denied, the order should contain reasons.
