The petitioners have disputed the amount claimed by the Bank in the Notice issued under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for brevity, 'the SARFAESI Act'). They also served the Bank with a Legal Notice dated 26.03.2018 (Annexure P-7). It is also claimed that statement of accounts is not being supplied to them. [2] The writ petition is disposed of at this stage, without expressing any views on merits, with a direction to the Branch Manager of the respondent-Bank to supply the statement of accounts to the petitioners to enable them to deposit the balance loan amount, if they so advised. However, if the petitioners fail to deposit the balance loan amount or do not submit any payment plan to the satisfaction of the Bank, the respondentBank shall be at liberty to proceed against them as per law.
