Petitioner filed the instant petition alleging willful and intentional violation of order dated 10.3.2006 passed by this Court in RSA No.4283/2005 whereby parties were directed to maintain status quo regarding possession till further orders and none of the parties to the appeal could alienate the suit property in any manner except with the prior permission of the Court.

Notice of the instant contempt was issued vide order dated 20.4.2007 and the same was ordered to be heard alongwith RSA 4283/2005. Thereafter this petition came up for hearing on 3.5.2017 on which date the following order was passed:- "As per office report, respondent Nos.2,4 & 6 have been served but none appeared on their behalf; respondent Nos.1 and 5 are reported to have expired whereas respondent no.3 could not be served for want of his correct address. Rajinder Parshad Joshi 2018.07.03 17:41 I attest to the accuracy and integrity of this document

COCP 470/2007 Let fresh notice to respondent no.3,on filing of his correct address within 3 weeks from today, be issued for 25.9.2017. Necessary steps be also taken for impleading the LRs of respondent No.1 and 5, if any before the next date of hearing." Thereafter, as on date notice, could not be issued for want of process fee, as observed in order dated 1.3.2018. At the time of hearing, learned counsel for the petitioner states at the Bar that despite repeated reminders, petitioner has not contacted him. From the above, it is apparent that the petitioner is not interested in pursuing the present petition.

Dismissed for non prosecution.
